What you should do to claim compensation for a car accident?

The first step is to contact us for a free initial consultation about your car accident claim. While many motor insurers will try to settle your injury claim directly with you, it is important to get early legal advice about how much compensation you might be entitled to.

You may be referred to a law firm by your insurer or another party, such as the garage repairing your vehicle, but you are free to make your own choice as to which law firm represents you.

How long do you have to claim after a car accident?

The standard time limit for starting a car accident claim in West Malaysia is within six (6) years from the date of cause of action accrued, ie. the date of the accident.

However, there are some exceptions to this general rules:-

  • Public Authorities: The Limitation period for bringing civil action against public authorities, including Federal Government and Government of the States, is 36 months from the date of accrual of the action.
  • Disability: If on the date when any right of action accrued for which a period of limitation is prescribed by the law, the person to whom it accrued was under a disability, the action may be brought at any time before the expiration of six (6) years from the date when such person ceased to be under disability or died, whichever event first occurred, notwithstanding that the period of limitation has expired.
  • Fraud or Mistake: Where there has been fraud or concealment by fraud on the part of a defendant, or an action if for relief from consequences of a mistake, the period of limitation does not run until the Plaintiff has discovered the fraud or mistake, as the case may be, or could with reasonable diligence have discovered it.
Can you make a car accident claim if it was your fault?

This depends on the circumstances of your car accident. If your car hit another vehicle, but this was due to the condition of the road and/or you was hit by another vehicle from the back for example, then you may be able to claim.

You might also have a claim if you were only partly to blame for the collision, or if you contributed to your injuries by not wearing a seatbelt. However, in these cases the amount of compensation awarded may be less, to reflect your partial responsibility.

If the driver of your car was to blame for the accident, you may be able to make a passenger claim.

How long does a car accident claim take to settle?
Every case is different, and several factors influence how quickly your car accident claim is settled. Some cases settle in a few months but others can take multiple years.

The length of your claim will depend on including and not limited to the followings:

  • How severe your injuries are – abrasions wound claims can settle within a few months, serious brain and spinal injuries can take much longer
  • Obtaining all the relevant documents such as police documents, medical reports, JPJ search (to determine the vehicle’s ownership, insurance information), employment documents, medical bills, medical certificate and other documents that support your case
  • How many witnesses involved to prove your case
How much compensation can you claim for a car accident?
